Terms & Conditions

1. Definitions

1.1. In this agreement Vedathemes (https://vedathemes.com/), may also be referred to as “we” or “us” or “our”.

1.2. “You” means you, along with your agents, employees, assigns, successors in interest, beneficiaries, and heirs.

1.3. This agreement as a whole may be referred to as the “Agreement” or as the “Terms and Conditions”.

1.4. “Product” means a Software for which you have purchased a license from Vedathemes.

1.5. “Subscription” means a license purchased from Vedathemes, which includes a Product license key and access to upgrades and support for the Product to which it applies.

2. Licensing

Our plugins are licensed under the GNU General Public License version 3.0 (https://www.gnu.org/licenses/gpl-3.0) and themes are licensed under the GNU General Public License version 2.0 (https://www.gnu.org/licenses/gpl-2.0) unless otherwise declared on theme or plugin page.

3. Subscriptions

Subscriptions are valid for one year from the date of purchase. A valid and active license key is required for automatic upgrades and support the Product.

You may not transfer your Subscription to another individual or organization without the express consent of Vedathemes. Transfer of your Subscription automatically and immediately terminates your Subscription and other benefits that may be associated with your Subscription.

4. Updates

If you have a valid and active license key as a result of having purchased a Subscription, you will receive Automatic updates for the duration of your Subscription.

Updates for the Product is provided as long as it is actively in development. Should any one of the following occur, we will no longer be responsible for providing updates for our product:

  • The Product is no longer actively developed as a viable product under Vedathemes.
  • Vedathemes or the parent company is purchased or bought out by another company.
  • WordPress is no longer actively developed.

5. Support

Support and updates are granted for one year after the original purchase based on the Subscription you have purchased. If you wish to receive Support after one year, you must renew your Subscription or purchase a new license key. Support cannot be provided if you do not have an active Subscription.

Support requests are handled on a first-come, first-serve basis. We will undertake Commercially Reasonable Efforts to resolve issues in a timely, courteous, and professional manner.

Support for the Product is provided as long as it is actively in development. Should any one of the following occur, we will no longer be responsible for providing support for our product:

  • The product (for which you have purchased a Subscription) is no longer actively developed as a viable product under Vedathemes.
  • Vedathemes or the parent company is purchased or bought out by another company.
  • WordPress is no longer actively developed.

6. Refunds

We stand behind our Product’s quality and your satisfaction with it is important to us. If you experience problems with the Product, we will be happy to provide a full refund within 30 days of the original purchase of the Subscription.

Refunds will be offered at our sole discretion and must meet all of the following conditions fully:

  • You are within the first 30 days of the original purchase of the Subscription.
  • Your issue(s) derives from not being able to install the Product properly or get the Product to perform its basic functions.
  • You have attempted to resolve your issue(s) with our support team by contacting us via email.
  • No refunds will be granted after the first 30 days of the original purchase whatsoever.
  • Refunds will not be granted for missing feature(s). If you are not sure we support a specific feature, please contact us first.
  • Issues caused by conflicts with 3rd party plugins, themes or other software will not provide grounds for a refund.
  • Refunds will not be granted if you simply decide not to use the Product.

7. Warranty

We are not responsible for any plugin or theme compatibility conflicts that may occur. The Product is provided “AS IS” and WITHOUT ANY WARRANTY. We hereby disclaim any and all warranty not expressly provided herein, included but not limited to the warranties of MERCHANTABILITY and of FITNESS FOR A PARTICULAR PURPOSE. You use the Product at your own risk. We are not responsible for any data loss that may occur as a result of installing the Software, and our liability for harm resulting from your use of the Software is expressly limited as provided herein.

8. Pricing, Billing & Privacy

We reserve the right to change pricing at any time for any or for no reason. We reserve the right to not honor typographical errors which may cause incorrect pricing on the website.

You warrant that information provided to us with respect to your identity and contact and billing information is correct and accurate, and you undertake a continuing duty to maintain accurate records with us. Failure to maintain accurate contact information may result in diminution of services including but not limited to Support Services and access to the Software, and we reserve the right to immediately terminate without refund your Subscription in the event of fraud or misrepresentation. We will absolutely never sell or share your personal information with third parties. All data we collect will be used for internal purposes only.

9. License Agreement

By purchasing our Product(s), you indicate and consent that you have read and agree to the Terms & Conditions listed and detailed on this page. We reserve the right to change or modify the current Terms and Conditions without prior notice or consent.

10. Severability

If any part of this agreement is declared unenforceable or invalid, all remaining clauses in this agreement shall remain binding on the customer.
